TERMS AND CONDITIONS FOR USERS

Caretaker Service

1. Platform Usage

Careait operates as a platform that facilitates the booking of nursing services based on the User’s specified requirements. These may include the patient’s condition, gender preference (male/female), and nurse's language proficiency. The User acknowledges that Careait provides a service connection and does not directly offer medical care.

2. Nurse Selection Process

Careait will notify nurses within a 5 km radius who meet the User's requirements. Upon a nurse's acceptance of the request, the nurse’s profile will be shared with the User for review. Once the User approves the selected nurse, Careait will assign the nurse to the job. Careait is not liable for delays or nurse unavailability due to external factors.

3. Payment Terms

The User agrees to make payments on a daily basis through the Careait app. Payments must be made promptly and in full to avoid interruptions to nursing services. Careait reserves the right to suspend or terminate services if payment is not made as required.

4. Responsibility for Nurse Performance

Careait assigns nurses based on the patient’s condition and the specific requirements provided by the User. Once the nurse arrives at the patient’s location, the User is responsible for managing the nurse’s performance and ensuring proper care. Careait disclaims any liability for incidents or outcomes within the User's home during care provision.

5. Support and Service Issues

The User is encouraged to contact Careait’s support team immediately if any issues or inconveniences arise during the service. Careait will make reasonable efforts to resolve such issues but is not responsible for delays or disruptions caused by external circumstances.

6. Non-Poaching Clause

The User agrees not to directly hire or attempt to poach any Careait staff, including nurses, without the direct involvement and permission of Careait. Any breach of this clause will result in legal action and may incur damages payable by the User.

7. Platform Access and Booking Fee

To access the Careait platform, the User must pay a non-refundable booking fee of INR 2000. This fee provides access to the platform for one year, during which the User may book unlimited nursing services. The fee is non-refundable under all circumstances, including service cancellation.

8. Payment to Staff

The User is prohibited from making direct payments to the Careait staff unless expressly authorized by Careait. Careait disclaims any responsibility for issues or disputes arising from unauthorized payments to staff.

9. Agreement to Terms

Using the Caretaker service, the User agrees to abide by these Terms and Conditions. Careait reserves the right to modify these Terms at any time, and continued use of the service following any updates constitutes the User's acceptance of the revised Terms.

Gold Nurse Service

1. Platform Usage

Careait operates as a platform that enables users to book nursing services by specifying the patient's condition and specific requirements, including but not limited to gender preference (male/female) and language proficiency of the nurse. The User acknowledges that Careait facilitates connections between Users and nurses but does not directly provide medical services.

2. Nurse Selection Process

Careait will notify available nurses within a 5 km radius who match the User’s specified requirements. If a nurse accepts the request, their profile will be shared with the User for review and approval. Once the User approves the nurse, Careait will assign the nurse to the job. The User understands that delays or changes in the nurse's availability may occur due to external circumstances.

3. Payment Terms

The User agrees to make daily payments through the Careait app. Payments must be made promptly to avoid interruptions in service. Failure to complete daily payments may result in service suspension or termination, and Careait reserves the right to take necessary actions to collect overdue payments.

4. Responsibility for Nurse Performance

Careait assigns nurses based on the patient's condition and the requirements specified by the User. Once the nurse enters the patient’s location, the User assumes responsibility for managing the nurse's productivity and ensuring proper care. Careait is not liable for incidents, accidents, or outcomes within the User’s home or premises while providing nursing services.

5. Support and Service Issues

The User agrees to contact Careait’s support team immediately if there is any inconvenience or issues related to the service. Careait will take reasonable steps to address concerns. Still, the User acknowledges that Careait is not responsible for delays or failures caused by third-party actions or circumstances beyond its control.

6. Non-Poaching Clause

The User is strictly prohibited from directly hiring, poaching, or attempting to employ Careait staff, including nurses, without the express involvement of Careait. Any breach of this clause will result in legal action, and Careait will seek damages or compensation for any resulting losses.

7. Platform Access and Booking Fee

To access the Careait platform, the User must pay a one-time booking fee of INR 2000. This fee grants the User access to the platform for one year, during which they may book unlimited nurses. The booking fee is non-refundable, regardless of whether the User discontinues service before the end of the access period.

8. Payment to Staff

The User must not directly pay the assigned nurses or any other Careait staff unless authorised by Careait. Any issues arising from unauthorised direct payments to staff are solely the User's responsibility, and Careait disclaims all liability for such matters.

9. Agreement to Terms

By utilising the Gold Nurse service, the User agrees to be bound by these Terms and Conditions. Careait reserves the right to modify these Terms at any time, and continued use of the platform after such modifications constitutes acceptance of the revised Terms and Conditions.

Silver Nurse Service

1. Booking Process

The User agrees to book nursing services through the Careait App (Blue Version) by providing accurate details of the patient's condition. The User acknowledges that misrepresenting the patient's condition may affect the service quality and Careait's ability to provide appropriate nursing care.

2. Nurse Selection Process

Careait will review the patient's condition and specific care requirements before sharing the profile of the most suitable nurse or semi-qualified nurse candidate with the User. The final decision on nurse deployment will be based on the User's confirmation of the selected candidate. Careait reserves the right to choose a nurse based on the available staff and patient needs.

3. Verification and Deployment

Careait will conduct a thorough verification process and provide basic training to all nurses and semi-qualified nurses. Upon the User’s confirmation of the nurse candidate, Careait will proceed with deployment. The User agrees that any delays in confirmation may affect the availability of the selected nurse.

4. Platform Access and Booking Fee

To access the Careait platform, the user must pay a one-time booking fee of INR 2000. This fee grants the User platform access for one year, during which they may book unlimited staff through Careait. The booking fee is non-refundable under any circumstances, including service cancellation by the User.

5. Payment Terms

The User agrees to clear all outstanding payments by the end of each calendar month or at the time of service cancellation, whichever occurs first. Please make timely payments to avoid service suspension or termination. Careait reserves the right to discontinue services if payment is not received within the stipulated time frame. Late payments may incur additional charges.

6. Responsibility for Nurse Performance

Careait performs comprehensive background checks on all nursing staff before deployment. However, the User acknowledges that they are responsible for ensuring the nurse's productivity and performance during the service. Careait will not be held liable for incidents, accidents, or other issues within the User's home while providing nursing services.

7. Support and Service Issues

If the Silver Nurse service is interrupted or a problem arises, the User must promptly notify Careait’s support team for resolution. Careait will address issues promptly but will not be held responsible for delays caused by third-party actions or circumstances beyond its control.

8. Non-Poaching Clause

The User agrees not to directly hire, poach, or otherwise engage any Careait staff, including nurses and semi-qualified nurses, without the explicit involvement of Careait. Any breach of this non-poaching clause will result in legal action, and Careait will seek compensation for any damages or losses incurred.

9. Agreement to Terms

By utilizing the Silver Nurse service, the User acknowledges and agrees to be bound by these Terms and Conditions. Careait reserves the right to update or amend these Terms at any time, and continued use of the service after such updates constitutes acceptance of the revised Terms.

10. Payment to Staff

Users must only pay the staff directly if Careait explicitly instructs them. Careait is not responsible for any issues arising from such payments.
